IMPORTANT: PLEASE READ THIS END USER LICENSE AGREEMENT CAREFULLY BEFORE INSTALLING OR USING THE LUA HEALTH APPLICATION ("APPLICATION"). BY INSTALLING OR USING THE APPLICATION, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS EULA. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS OF THIS EULA, DO NOT INSTALL OR USE THE APPLICATION.
1. DEFINITIONS
(a) "App" refers to the Lua Health application available on the Microsoft Teams Store.
(b) "Developer" refers to the entity or individual responsible for the development and distribution of the App.
(c) "User" refers to any individual or entity that installs, accesses, or uses the App.
2. LICENSE GRANT
(a) License: Subject to the terms of this EULA, the Developer grants the User a limited, non-exclusive, non-transferable, revocable license to install and use the App for the sole purpose of enhancing their experience within Microsoft Teams.
(b) Restrictions: The User shall not:
i. Modify, decompile, reverse engineer, disassemble, or attempt to discover the source code of the App.
ii. Distribute, sublicense, lease, lend, or otherwise transfer the App or its license to any third party.
iii. Use the App for any illegal, unauthorized, or unethical purposes.
iv. Remove or alter any copyright, trademark, or other proprietary notices contained in or on the App.
3. SUPPORT AND UPDATES
(a) Support: The Developer may provide support and updates for the App at their discretion. Such updates may be necessary to maintain compatibility with Microsoft Teams or to provide new features and improvements.
(b) No Obligation: The Developer is not obligated to provide any support, updates, or maintenance services for the App.
4. PRIVACY AND DATA COLLECTION
(a) Privacy Policy: The User acknowledges that the App may collect and transmit user data to the Developer for the purposes of improving the App's functionality and performance. The User's data will be handled in accordance with the Developer's privacy policy, which can be accessed through the App's settings or documentation.
5. TERMINATION
(a) Termination by User: The User may uninstall the App at any time to terminate this EULA.
(b) Termination by Developer: The Developer reserves the right to terminate this EULA and revoke the User's license to use the App if the User violates any of the terms and conditions outlined in this EULA.
6. DISCLAIMER OF WARRANTIES
THE APP IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THE USER ASSUMES ALL RISKS ASSOCIATED WITH THE USE OF THE APP. 7. LIMITATION OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE APP, EVEN IF THE DEVELOPER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
8. GOVERNING LAW
This EULA shall be governed by and construed in accordance with the laws of the jurisdiction in which the Developer is based, without regard to its conflict of law principles.
9. ENTIRE AGREEMENT
This EULA constitutes the entire agreement between the User and the Developer with respect to the App and supersedes all prior or contemporaneous understandings, agreements, representations, and warranties.
